Playa del Carmen Aguakan office raided by federal authorities

Playa del Carmen, Q.R. — An Aguakan office in Playa del Carmen was raided by state and federal authorities Wednesday for the deviation of more than 1.2 billion peso.

The water service provider has been under audit due to an alleged deviation in excess of 1.2 billion peso from a tax credit that was granted to the company. The Aguakan office on 115th Avenue was over run with personnel of the Dirección de Recuperación de Adeudos y Ejecución Fiscal (Direction of Recovery of Defaults and Fiscal Execution) of Comisión de Agua Potable y Alcantarillado (CAPA) along with police.

The federal and state officials entered the office to proceed with the insurance of the property. Inside, the private security guard evicted customers and closed the doors. Moments later, officials from the Potable Water and Sewerage Commission (CAPA), who requested the embargo, arrived.

Hours earlier, the same situation occurred at the Aguakán offices in Cancún located on Uxmal Avenue where state police, actuaries and CAPA officials intervened.

Two weeks ago, the director of CAPA, Gerardo Mora Vallejo, revealed that in a review of Aguakan finances they detected an alleged deviation of 1.226 billion peso from a tax credit to Aguakan, which was not used for the purposes indicated by the company.

Comisión de Agua Potable y Alcantarillado (CAPA) issued a statement explaining that the procedure was carried out to perform an inventory of the assets in the Aguakan offices derived from the intervention process of the Dirección de Recuperación de Adeudos y Ejecución Fiscal.

According to José Luis Domínguez, in legal terms it is a negotiation embargo, clarifying that Aguakan continues to be the supplier the water and sewerage service in the municipality of Solidaridad.

State governor Carlos Joaquín González says they already have results of the audits, which are still being deliberated, but that they expect to have good results from the findings, something that is essential.

“Sometimes it is thought that the only situation is to rescind this concession, sometimes legally it is not so simple and what you have to do is a thorough review of how you are fulfilling each of the different points.

“Today they have already been notified of the situation and we will be reviewing point to point with them,” he explained.

At the moment, he said he did not have the exact data of the differences between each of the details included in the concession title, but that it will be reviewed in detail one by one, and if they do not legally comply with the stipulations of the contract, a revocation would be feasible.
